Abstract

The research paper discusses the Mental Health Act 2017. Examines the paradigm moves towards rights-based care, thereby identifying a gap in rehabilitation for different groups, like rape victims, survivors of sexual harassment, and other disabled individuals under other various acts allied with the Mental Health Act. It deeply absorbs the connection of the mental health paradigm with other national and international laws and guidelines. It criticizes the lack of interlinkage between the statutes of the Mental Health Act and execution, which leads to fragmented support, a lack of infrastructure, and the utilisation of resources and overlooked mental health problems and illnesses. Despite having advance directives for mental health and community integration, all the above-mentioned problems pertain. This paper proposed the reforms with respect to legislative changes for holistic integration, improvement in provisions for rehabilitation and deep association with constitutional rights under Article 21 to create a comprehensive mental health regime aligned with the international framework and goals for mental health.
